The will Hernán Cortés made in Seville in October 1547, weeks before his death: the full Spanish text, clause by clause, followed by a complete English translation.

The will of Hernán Cortés: English translation
A complete translation of the Spanish text above, made for amatl from Alamán's 1844 edition. Clause numbers link back to the Spanish. Names of people are given in their usual modern form, and place names in their modern spelling (Coyoacán, Texcoco, Cuernavaca, Tlaltizapán). Words in square brackets are the translator's. Cortés's own word for the events of 1519–1521 is «conquista»; inside the document we translate his words as he wrote them.
Delivery of the original will to Melchor de Portes (Seville, 18 August 1548) → ES
In the name of God, Amen. Be it known to all who see this present instrument that in the most noble and most loyal city of Seville, on Saturday the eighteenth day of the month of August, in the year of the birth of Our Saviour Jesus Christ one thousand five hundred and forty-eight, García de Huerta, notary of His Majesty, gave and delivered to me, Melchor de Portes, public notary of Seville, the original will which the very illustrious Lord Don Fernando Cortés, Marquis of the Valley of Oaxaca, which is in New Spain of the Ocean Sea, made and executed before me, the aforesaid public notary Melchor de Portes, closed and sealed, and which he executed on a Wednesday, the twelfth day of the month of October of the past year one thousand five hundred and forty-seven. And upon the death of the said Lord Marquis it was opened before the said García de Huerta, in the village of Castilleja de la Cuesta, on the third day of the month of December of the said year fifteen hundred and forty-seven, by order of the Licentiate Don Andrés de Jáuregui, deputy of the Asistente of this city. I asked that the said will be given and delivered to me in the original, so that I might keep it in my possession, since it had been executed before me; and the lords judges of the Royal Audiencia de los Grados of this city of Seville, by a judgment at first instance and on review, ordered the said García de Huerta to give and deliver the said original will to me, so that I might keep it in my possession, and they issued a writ for the said García de Huerta to give and deliver the said original will to me. That writ is as follows.
Writ of the Royal Audiencia of Seville (16 August 1548) → ES
We, the judges of the Royal Audiencia who reside in this city of Seville on behalf of His Majesty, order you, García de Huerta, notary of Their Majesties, that as soon as this writ is served on you, you give and deliver to Melchor de Portes, public notary of this city, the original will of the Marquis del Valle that was opened before you. We order you to do and fulfil this in execution of the judgments that we gave and pronounced against you in the suit that you brought and pursued before us with the said Melchor de Portes over who is to hold the said will. We order you to do and fulfil this at once, with the warning that if you do not, we shall issue a writ for your arrest; and in all else we order you to comply with the judgments as they are written. Given on the sixteenth day of the month of August, one thousand five hundred and forty-eight. — Licentiate Medina. — Licentiate Castilla. — Licentiate Baltasar de Salazar. — Doctor Cano. — I, Juan Hurtado, notary of Their Majesties and of the Audiencia of the lords judges, had it written by their order.
Entry in Portes's register → ES
By virtue of the said writ, the said García de Huerta gave and delivered to me the said original will, which the said Lord Marquis del Valle had executed closed and sealed before me, together with its deed of execution, signed by the said Lord Marquis, signed and marked with my sign as the said public notary, and signed by the witnesses who were present; and I placed and entered it in my register. The tenor of the said will, with the deed of execution that he made before me when he executed it closed and sealed, exactly as the said García de Huerta gave and delivered it to me, is as follows.
Execution of the closed will (12 October 1547) → ES
In the most noble and most loyal city of Seville, on Wednesday the twelfth day of the month of October in the year of the birth of Our Lord Jesus Christ one thousand five hundred and forty-seven, in the houses where the most illustrious Lord Don Fernando Cortés, Marquis del Valle, is at present lodged, which are in the parish of San Marcos, in the presence of me, Melchor de Portes, public notary of Seville, and of the witnesses named below, the said Lord Marquis appeared, sick in body but in his natural senses, such as God Our Lord was pleased to give him, and presented before me, the said public notary, this closed and sealed writing, which he said is his will, closed and sealed. He said that it was written on eleven sheets of paper, counting the one bearing his signature and those of the Licentiate Infante and of Melchor Mojica, accountant of the said Lord Marquis, and that his name was signed at the foot of each sheet; I, the said notary, saw those signatures, because I closed the said will. He said that he executed this will as his closed and sealed will and wished it to be fulfilled as it is written; that he left as his heirs and executors those named in it; and that he revoked every will, bequest and codicil he had made until today, so that none should be valid but this one. He asked me, the said public notary, to give him a certificate of it, and I gave this one, made on the day, month and year above. The said Lord Marquis signed it with his name. Witnesses present: Martín de Ledesma, Diego de Portes and Pedro de Trejo, notaries of Seville; Antonio de Vergara; Juan Pérez, attorney; Don Juan de Saavedra, chief constable of Seville; and Juan Gutiérrez Tello, son of Francisco Tello, residents of this city of Seville. Corrected: «decir», «veinte y cuatro», «de Sevilla»; let it not prejudice. — The Marquis del Valle. — Juan Gutiérrez Tello. — Don Juan de Saavedra. — Antonio de Vergara. — Diego de Portes, notary of Seville. — Juan Pérez. — Pedro de Trejo, notary of Seville. — Martín de Ledesma, notary of Seville. — And I, Melchor de Portes, public notary of Seville, had it written, set my sign here, and am a witness. — Melchor de Portes, public notary of Seville.
Invocation and preamble → ES
In the name of the Most Holy Trinity, Father, Son and Holy Spirit, three persons and one only true God, whom I hold, believe and confess to be my true God and Redeemer, and of the most glorious and blessed Virgin, His holy mother, our Lady and Advocate. Know all who see this testament that I, Don Fernando Cortés, Marquis of the Valley of Oaxaca, Captain General of New Spain and of the South Sea for His Caesarean Majesty the Emperor Don Charles, fifth of that name, King of Spain, my sovereign prince and lord, being sick, but in my free and natural judgement such as God Our Lord was pleased to give me, and fearing death, as is natural to every creature, and wishing to be prepared for whenever it be God's will to take me, and for what serves the good of my soul and the security and discharge of my conscience, grant and acknowledge by this instrument that I make and order my will, last and final wish, in the following form and manner.
1. First, I order that if I die in these kingdoms of Spain, my body be laid and deposited in the church of the parish in which the house where I die stands, and that it remain there on deposit until such time as my successor sees fit to carry my bones to New Spain. I charge and order him to do this within ten years, and sooner if possible, and to take them to my town of Coyoacán, and there to bury them in the convent of nuns that I order to be made and built in my said town, under the name of the Conception, of the Order of Saint Francis, in the burial place that I order to be made in the said convent for this purpose, which I designate and establish as the burial place for myself and my successors.
2. Item, I order that at the time of my end and death, if God is pleased that it be in these kingdoms of Spain, my burial be carried out as and in the manner that the lords whom I name as my executors, or whichever of them is present, think fit, provided that the things set down concerning it are done and fulfilled.
3. I order that, besides the beneficed curates and chaplains of the said parish church who are to come to carry my body, the friars of all the orders that there may be in the city, town or place where I die be called and brought, to walk in procession with the Cross and to attend the funeral rites said for me; and I order that the said orders be given the customary alms, as my said lords executors see fit.
4. Item, I order that on the said day of my death fifty poor men be clothed at the cost of my estate, in long gowns of brown cloth with hoods of the same; that these fifty men walk with lighted torches at my burial; and that afterwards each of them be given one real.
5. Item, I order that on the day of my burial, if it be before noon, or otherwise on the day following, as many masses be said as can be said in all the churches and monasteries of the said city, town or place where I die; and that, beyond the masses said on that day, masses continue to be said on the following days until five thousand masses have been completed, endowed in this way: one thousand masses for the souls in purgatory; two thousand for the souls of those who died in my company and service in the conquests and discoveries of lands that I made in New Spain; and the remaining two thousand masses for the souls of those persons towards whom I have obligations that I do not remember or know of (those that are known I have ordered to be fulfilled and paid as this will directs). For the alms of these five thousand masses my lords executors will order the customary stipend to be paid; and I ask and beg them that whatever else they order and direct concerning my burial be aimed at avoiding the things that are usually done for worldly show and pomp, and that these be turned instead to the good of souls.
6. Item, on the said day of my burial, let all the servants in my service and that of my children be given suitable mourning clothes, as my said lords executors see fit. To those who are or shall be my servants I order that, for six months after my death, they be paid the wage they earn with me at the time, and that throughout that time they be given food and drink in the same way as during my life; and that, when those who do not remain in the service of Don Martín, my son and successor, come to leave, they be paid in full whatever is owed to them of their wages.
7. Item, I order that when my said bones are carried and moved to the said New Spain, to be buried in the church of the said convent of Coyoacán that I order to be made and built, this be done in the manner and order that the Marchioness Doña Juana de Zúñiga, my wife, and the present or future successor of my house, or whichever of them is then alive, think fit.
8. Item, I order that the bones of Doña Catalina Pizarro, my lady and mother, and of Don Luis, my son, which are buried in the church of the monastery of San Francisco of Texcoco, and of Doña Catalina, my daughter, who lies in the monastery of Cuernavaca, be brought and placed in my burial place in the said convent that I order to be built in my said town of Coyoacán.
9. Item, I order that the building of the hospital of Our Lady of the Conception, which I am having built in the city of Mexico in New Spain, be finished at my cost, according to and in the manner in which it has been laid out; and that the main chapel of its church be finished according to the wooden model that has been made, which Pedro Vázquez, geometrician, made, and according to the plan described in the paper that I sent to New Spain this present year of fifteen hundred and forty-seven. For the costs of building the said hospital I specially assign the rent of the shops and houses I own in the said city of Mexico, on the square and on the streets of Tacuba and San Francisco, and on the street that runs from one to the other. I order that this rent be spent on the said building and on nothing else until it is finished, and that the successor of my house may not use it for anything else; but it is my will that it be spent at the disposition and direction of my said successor as patron of the said hospital. Once its building is finished according to the said plans, the said rent of the said shops and houses is to be spent on the works and endowments that will be declared below. And I order that, in all that concerns the administration or government of the said hospital, the foundation charter that I shall leave drawn up before a public notary be kept and fulfilled; and failing that, if it is not declared and made, I order that the form and manner of administration be followed that is kept in the hospital of the Five Wounds in this city of Seville, founded by the lady Doña Catalina de Ribera, may she be in glory, as regards its administrators and chaplains and the other officers and servants who are to serve in the said hospital.
10. Item, I order that in the chapel where Martín Cortés, my lord and father, lies buried, in the monastery of San Francisco of Medellín, the memorial services and masses that I have ordered in a foundation I leave for this purpose be held every year in perpetuity, and that my successor and successors fulfil and carry this out for ever. To this end I name and appoint Don Martín Cortés, my son and successor, as patron of the said chapel, and after him those who succeed him in my house. The said patron, and those who succeed him in my entail, may appoint in their place, and delegate their powers concerning the said patronage to, whatever person or persons they wish, for as long as they wish; they may revoke that appointment whenever they wish and name another person or persons as they see fit, as often as they wish; and the person so named shall have, in the absence of my said successor, the same power and authority as the said patron for the time for which he is named.
11. Item, I say that, since God Our Lord Almighty was pleased to guide and favour me in the discovery and conquest of New Spain and of all the provinces subject to it, I have always received from His merciful hand very great favours and mercies, both in the victories I won over the enemies of His holy Catholic faith and in the pacification and settlement of all those kingdoms, from which great service to God Our Lord has resulted and, I hope, will result. In acknowledgement of those graces and mercies, and to discharge and make amends for any fault or obligation that may burden my conscience, which I do not remember and so cannot order to be satisfied in particular, I order that the following works be carried out.
12. I ordain and order that, besides the said hospital that I ordered to be made for this purpose and that is being made in the city of Mexico, as stated above, there be built in my town of Coyoacán, in New Spain, a convent of nuns under the name of the Conception, of the Order of Saint Francis, in the place and in the form that I shall indicate in a foundation charter I shall leave; and I order that this be kept and fulfilled as it is written. If I do not leave it declared, I order that the present or future successor of my house make and build it, and people and endow it, from the rent that will be declared below. I designate the said convent in my said town of Coyoacán as the burial place for myself and my successors, as has been said, and I order that it be in the main chapel to be made in the convent church, and that no one may be buried there, nor be allowed to be, except my legitimate descendants.
13. Item, I order that a college be built and maintained in my said town of Coyoacán for students of theology and canon law, so that there may be learned persons in the said New Spain to govern the churches and to inform and instruct its native people in the things of our Catholic faith. The college is to have the number of students and the faculties, and to keep the rules or constitutions, that will be declared in the foundation charter I leave for it, and is to be built in the place and in the form declared in that charter, with the conditions, ordinances and statutes that I shall also declare in it. If by chance I do not leave this declared, I order that the present or future successor of my house make and build it, and that the statutes, constitutions and ordinances of the college of Santa María de Jesús, founded in this city of Seville, be kept; and that the costs and expenses of building the said college be met and paid from the money and rents that will be declared below.
14. Item, whereas for the endowment of the said hospital of Our Lady of the Conception that I am building in Mexico I assigned two building plots opposite the houses of Jorge de Alvarado and of the treasurer Juan Alonso de Sosa, between my house and the canal that runs past it to the houses of Don Luis de Saavedra, where the market is held, and bound myself to build houses on them, as is set out at greater length in the said endowment, to which I refer; and whereas, until those houses were built, one hundred thousand maravedís of good money were to be given from my estate to the said hospital and its building: I order that the said endowment be fulfilled according to and in the manner it sets out, with the additions stated below. And I order that if the successor of my house should at any time wish to give the said hospital, in place of the said houses, the said one hundred thousand maravedís of rent from some other source, he may do so, and may place it wherever he wishes, provided it is secure.
15. Item, whereas in the said grant I also stated and bound myself to give the said hospital lands near the city of Mexico capable of yielding up to three hundred fanegas of wheat, as is set out in the said endowment to which I refer, I order that this be fulfilled. For its fulfilment I assign a piece of land that I own within the bounds of Coyoacán, lying between the said town of Coyoacán and the river that crosses the road from that town to Chapultepec; and if that land is not enough, let the rest be made up from the other lands where I have had and have my farms, which lie on the other side of the said river towards Chapultepec, in the part my said successor thinks fit. If my said successor or successors should at any time wish to give other lands yielding three hundred fanegas of wheat for the said hospital, in keeping with the said endowment, they may do so, provided these are as good as the ones I assign. And because I do not know whether the lands I have assigned and named for the said hospital belong by right to some other party, and do not belong to me as lord of the said place or in any other way, I order that in that case they be restored to their owners and that the owners be paid what they are worth, as the owners prefer. And because I have farmed those lands and profited from them in the belief that I could do so without burden on my conscience, I order that whatever profit I appear to have drawn from them be paid to those to whom the lands belong, so that my conscience is discharged; and if the lands prove not to be mine, the successor of my house shall be bound to give the said hospital sufficient compensation, in keeping with the said endowment.
16. Item, I declare and say that, whereas, as has been said, I have ordered and ordained that the building of the said hospital in Mexico be finished with the money yielded by the lands and houses I own in the said city, on the square and on the streets of Tacuba and San Francisco, as stated and declared above, and that once the building of the hospital was finished the rent of those shops and houses was to remain at the disposition of my successor and the successors of my house: I order that whatever the said shops and houses are worth and yield from then on be spent in full each year on the building and construction of the convent of nuns and of the said college that I order to be made and built in my said town of Coyoacán, and that on these works there be spent and distributed whatever money is needed to bring them into service.
17. And so that the works of the said hospital, convent and college described above may be finished more quickly, and the service to God Our Lord that is hoped for from them may be the sooner received and done, I order that, besides the four thousand ducats of rent from the said shops and houses that I assign to the works of the said hospital being built in Mexico and of the said convent and college that I order to be made in Coyoacán, a further six thousand ducats be taken and given from my estate every year after my death, making ten thousand ducats together with the four thousand from the said houses. These are to be spent as follows: the four thousand ducats of rent from the said shops and houses on the building of the said hospital until it is finished as planned; three thousand ducats on the building and construction of the said convent of nuns; and the remaining three thousand ducats on the building of the said college. Once the building of the said hospital is finished, the four thousand ducats assigned to it are to be applied and spent in equal halves on the works of the said convent and college, so that five thousand ducats are spent on each of them every year. When those works are finished, my said successor shall no longer be bound to give the six thousand ducats, and the four thousand ducats of rent from the said shops and houses shall from then on and for ever be assigned as follows: one thousand ducats for the endowment and revenue of the said convent of nuns that, as has been said, I order to be made and built in my town of Coyoacán; two thousand ducats for the endowment and expenses of the said college that I order to be founded in the said town; and a further one thousand ducats I assign and award to the said hospital of the Conception that I am having built in the said city of Mexico, on the condition that, in return for those thousand ducats a year, the hospital waive and release the obligation that I and my successor and successors have to build houses on two plots opposite the houses of Jorge de Alvarado and of the treasurer Juan de Sosa for the hospital's endowment, and the obligation we also have to give the hospital one hundred thousand maravedís of rent a year while those houses are not built; and that it likewise waive and leave me and my successors free of the obligation I took on when I endowed the said hospital to give it lands near the city of Mexico capable of yielding up to three hundred fanegas of wheat. For it is my intention and will that, the said thousand ducats being awarded to the said hospital every year in perpetuity, it waive and release these claims, and that I and my said successors be free of its right to the said houses, to the hundred thousand maravedís of income while they are not built, and to the said lands yielding three hundred fanegas of wheat; and I order that all of this, and every part of it, return to the successor or successors of my house, to enjoy and dispose of at will. If the said hospital does not waive and release these claims, I order that this bequest and endowment of a thousand ducats a year be void and of no force or effect, and that the successor of my house and estate have and keep it.
18. Item, I say that, since experience shows that the rents of lands and houses grow every day, both in these kingdoms of Spain and in New Spain, and since my said shops and houses in the city of Mexico described above may therefore come to be worth and yield more than the said four thousand ducats that I assign and award for ever, as has been said, to the endowments of the said convent of nuns, the said college and the said hospital, it is my will that whatever more those shops and houses may at any time be worth and yield be assigned to the same purpose. And I ordain and order that whatever they yield above the said four thousand ducats be divided as follows: two parts of the surplus for the said college, and the other two parts in equal halves for the said convent of nuns and the said hospital.
19. Item, I say and order as follows. By virtue of the grant that the Emperor, our lord the King, made me of the towns named in it, the patronage of the churches of those towns belongs to me, under a clause of that grant which says that I am to have in those towns all the rights, contributions and customs, and all the other things that His Majesty has or shall have in the towns of New Spain that remain to his royal crown, except mines and salt works; and apart from those two things excepted in the privilege, the patronage, as he holds it, therefore also belongs to me. Besides the grant made to me by His Majesty, I hold the said right of patronage (ius patronatus) by concession of His Holiness, and the bull for it is in the hands of His Majesty and of the members of his Council of the Indies, so that they may approve and confirm the concession. It is my will that the present and future successor or successors of my house have and hold the said right of patronage for ever. And because, when I asked His Holiness for the concession, my intention was that the natives of those towns be better instructed in the things of our holy Catholic faith, I order and charge Don Martín, my son and successor, and the successors after him, to take very special care in this, filling the benefices of those towns with able persons of good life and example, on condition that they work daily at the instruction of the said natives; and that they take great care to inspect and to learn very often how this is being done and fulfilled. And since the said concession of His Holiness says that I and my heirs and successors are to have and collect all the tithes and first fruits of the towns covered by the said right of patronage, on condition of endowing their churches, I order that everything needed for those churches, their altars, ornaments and all other things necessary for worship, and for wine and the administration of the holy Sacraments, be paid from the said tithes and first fruits; and that until this is fulfilled, neither my said successor nor the successors of my house and estate may take for themselves anything from the said tithes and first fruits, for from now and for ever I apply and assign them to the said churches and to everything annexed and belonging to them, as far as is needed for the things set out above, the said successors keeping the freedom and use of the said right of patronage as it was granted to me. And since it is my will that whatever is left of the tithes and first fruits of those churches, once the said expenses and needs have been met, be distributed and spent on works of God's service and on nothing else, being goods offered to God Our Lord and to His holy temples, I say and order that the surplus of the tithes and first fruits, once the things set out above have been fully met each year, at the discretion and direction of my said successor or successors and of the person or persons they appoint and name, be assigned in perpetuity as follows: half to the endowment of the said college, and the other two parts in equal halves to the said convent and the said hospital, in keeping with the division made between them of the rents of the said shops and houses.
20. Item, I order that the Marchioness Doña Juana de Zúñiga, my wife, be paid ten thousand ducats that I received as her dowry, since I received and spent them and they are hers; and I order that they be paid to her without any lawsuit or dispute, from the first and best of my goods.
21. Item, I say that the lord Don Pedro Álvarez Osorio, Marquis of Astorga, and I have agreed and concluded that Don Álvaro Pérez Osorio, his firstborn son and heir to his house, is to marry Doña María Cortés, my legitimate daughter by the said Marchioness Doña Juana de Zúñiga, my wife, in the form and manner set out in the marriage contract we have drawn up; and it is my will that this be fulfilled and kept as that contract states. And since I have promised the said Doña María, my daughter, a dowry of one hundred thousand ducats, of which the said lord Marquis of Astorga has received twenty thousand ducats under the said articles, I wish that, before anything else, the remaining eighty thousand ducats needed to complete the said dowry be paid from the goods of the said Marchioness, my wife, and from mine; and that whatever part of them remains to be paid be paid at the time and in the manner set out in the said contract. The said Doña María, my daughter, is to have this on account of the legitimate share due to her from our goods.
22. And since I am bound to provide dowries for Doña Catalina and Doña Juana, my legitimate daughters by the said Marchioness, my wife, in fulfilment of that obligation, in the best way I can and as the law allows, I order that each of them have a dowry of fifty thousand ducats, making one hundred thousand ducats for the two. I make an irrevocable gift of these, between living persons, to my said daughters, through Melchor de Mojica, my accountant and secretary, who is present and accepts it on their behalf. They are to have the said one hundred thousand ducats from the goods belonging to the said Marchioness Doña Juana de Zúñiga, my wife, and to me, on account of the legitimate shares they are to receive from our goods; and I order that the said one hundred thousand ducats be paid from the goods of the said Marchioness and mine that remain at the time of my end and death. If there are not enough goods to make up the said one hundred thousand ducats, I wish that whatever is lacking be made up and paid by Don Martín Cortés, my son and successor, or by any other successor to my estate, taking fifteen thousand ducats each year from the rents of my said estate until the said one hundred thousand ducats have been paid in full, as has been said. And I, the said Melchor de Mojica, say that I accept and receive the said gift of one hundred thousand ducats on behalf of the said ladies Doña Catalina and Doña Juana, as this clause states, and in confirmation and truth of it I have signed my name here. — Melchor de Mojica.
23. Item, I order, and lay as a charge on my successor and on the rents of my house, that Don Martín and Don Luis Cortés, my natural sons, each be given one thousand gold ducats a year from those rents, worth three hundred and seventy-five thousand maravedís, for as long as they live or until each of them has an income of five hundred thousand maravedís or more. I order that this be assigned and paid to them from my said rents every year, as has been said, free of accounting fees or any other charges; and from now I place and assign it to them as their own on my said rents, from the best of them. And I order my said sons Don Martín and Don Luis to serve, respect and obey the said successor to my estate in all things that they may lawfully and honestly do, as the principal stock and head from which they descend; never to disobey or disrespect him for any reason; and to stand by him and serve him, provided it is not against God Our Lord, against His holy religion and Catholic faith, or against their natural king. And I order that if open disobedience or disrespect should appear in either of them, so marked as to be notorious and proven, he shall by that very fact lose the benefit and maintenance he receives, and I order that he be held a stranger to my house and lineage.
24. Item, I order that when the said Doña Catalina and Doña Juana, my daughters, or either of them, come to marry, it be with the counsel and approval of the said Marchioness, their mother, and of the said successor of my house; and that if either of my said daughters marries outside this rule, the said successor of my house shall not be bound to give her anything of what I order for her dowry.
25. Item, I order that Doña Catalina Pizarro, my daughter by Leonor Pizarro, who was the wife of Juan de Salcedo, resident of the city of Mexico, be given everything that the cows, mares and sheep I gave her when I came to the kingdoms of Spain appear to have yielded and increased, together with all the rents and tributes that the town of Chinantla has yielded her, and everything else I assigned her for her dowry and marriage, all of which was handed over to the said Juan de Salcedo, husband of the lady Doña Leonor Pizarro, her mother. And since I have received from the produce of those herds a quantity of horses, steers, rams and money, I order that, according to the account of it that the said Juan de Salcedo may have left, the said Doña Catalina, my daughter, be paid from my goods and house at the prices current when I received them. And I confess that two bonds which Hernando de Saavedra and Gil González de Benavides made to me for a certain sum of pesos of gold, for some cows I sold them on four instalments, as the said bonds to which I refer will show, although they are made out to me, belong to and came from the goods and increase of the herds of the said Doña Catalina, my daughter; and I order that they be given and delivered to her, with everything that has been collected on them, because it is hers and came from her property. The amounts of the said bonds are two thousand pesos of good gold for one, and two thousand seven hundred and fifty pesos for the other.
26. Item, I declare that another bond, which Francisco de Villegas, resident of the city of Mexico, made to me for two thousand pesos of gold for some cows, of which he owes only one thousand (as the said Juan de Salcedo stated in a note signed with his name, because he did not receive the full number of cows sold to him), likewise comes from the goods of the said Doña Catalina, my daughter; and I order that it be given to her.
27. Item, I declare that another bond, which Bernardino del Castillo made to me for four hundred pesos of mine gold for two mares, likewise belongs to and comes from the goods of the said Doña Catalina, my daughter; and I order that it be given to her.
28. Item, I declare that another bond, which Alonso Dávalos made to me for two thousand four hundred pesos of good gold for twelve mares and six fillies, belongs to and comes from the goods and property of the said Doña Catalina, my daughter; and I order that it be given to her.
29. Item, I declare that all the cows and sheep at Matalango belong to the said Doña Catalina, my daughter, and to the said Leonor Pizarro, and also all the mares and colts at Tlaltizapán bearing her brand, which is a large E on the haunch.
30. Item, I declare that, on the bond that the said Gil González de Benavides made with Hernando de Saavedra, which as has been said belongs to the said Doña Catalina Pizarro, my daughter, the said Gil González has paid three hundred and fifty castellanos of mine gold, and I received them in the form of four horses. I am answerable for them, and I order that they be paid to the said Doña Catalina.
31. Item, I declare that I gave the said Juan de Salcedo, resident of Mexico, husband of the said Leonor Pizarro, a discharge in which I said that I released him, and did release him, from all the accounts he had concerning the property and goods of the said Doña Catalina Pizarro, my daughter, that had been handed over to him. I say that I gave the said discharge, although I had no standing to give it, without any account or payment, at the request and entreaty of the said Juan de Salcedo, so that he might avoid rendering those accounts in my absence; for he promised me on oath that, when I returned from the expedition on which I was setting out, he would render them very fully and without fraud, and that he would sooner help her from his own property than take anything from the said Doña Catalina Pizarro. He did so in the presence of Andrés de Tapia, who witnessed it.
32. Item, I order the said Doña Catalina, my daughter, that when it pleases Our Lord that she marry, she do so with the counsel and approval of the present or future successor to my estate; and I ask him to take special care to see that the said Doña Catalina, his sister, marries as befits the honour of his house and the good and honour of the said Doña Catalina.
33. Item, I order that Doña Leonor and Doña María, my natural daughters, each be given ten thousand ducats from my estate for their dowries and marriages; and I order and charge them to marry with the counsel and approval of my said successor, whom I charge and order to do for them the same as in the preceding clause concerning Doña Catalina, their sister. And if the said Doña María, or either of them, dies before marrying, or wishes to enter religious life or some other such state, then each of them is to be given sixty thousand maravedís a year for her expenses and maintenance, and the rest is to return to and be had by the said Don Martín, my son, successor to my estate, and those who succeed him.
34. Item, I order that, since some persons have served on my estate and farms and I do not know whether I paid them for their service, on proof of how they were taken on by me or by my stewards and the persons in charge of my estates, of what service they gave, and of the terms agreed when they were taken on, they be paid whatever is owed to them as shown in the books of my estate. This is to be done without wearying them with lawsuits, beyond finding out the truth, and is to rest on the conscience of my successor and executors, who need give no further account or justification for why they paid it.
35. Item, I order that, according to my account books, all the wages and other agreed payments of the people who have served me, both in New Spain and in these kingdoms of Spain, be paid in keeping with the contracts made with them, for the time they appear to have served; and that this be done without any delay or lawsuit, but in accordance with those contracts. And because the reckoning of what Bernardino del Castillo had served me was left pending and referred to the Licentiate Don Juan Altamirano, I order that the settlement the said Licentiate has made of it be fulfilled.
36. Item, I order that all the debts I appear to owe by any instrument, public or private, if it is established that the debt is truly mine, be paid without any delay or legal dispute, as quickly as possible, and without the creditor having to incur costs to collect it. And since I may owe some debt for which no instrument was made, I order that whatever it appears in full that I owe, even if not in writing, be paid without legal dispute on summary proof, up to the sum of one hundred pesos in good money.
37. Item, I say that I have spent a great sum and quantity of money in New Spain and its provinces, which I conquered, pacified and brought under the yoke and service of the royal crown of Castile, both in the conquest of New Spain and its provinces and in fleets I sent beyond it: those I dispatched to the Moluccas, under the command of Álvaro de Saavedra, Gerónimo Primo [the printed text is corrupt here; it has been suggested that it should read «Álvaro de Saavedra Cerón, my cousin»]; the one I dispatched to Las Hibueras, which went under the command of [a name appears to be missing here] with settlers; and another to the said province of Las Hibueras, commanded by Francisco de las Casas. All of these went by order of the Emperor our lord, as his royal instructions and signatures show. And since His Majesty, to discharge his royal conscience and as a most Christian prince, has ordered by a royal decree of his, which is among the papers left with the Licentiate Juan Altamirano, and even by a judgment given in his royal Council, that an account be made with me of everything I have spent, both on the said conquests and on the said fleets, I order that this account be made and that whatever is found owing from His Majesty be collected, since he was pleased to order that it be paid to me. It is my will that whatever is so collected and found owing be had and inherited by the said Don Martín Cortés, my son, successor of my house, and by the other successors who succeed in it.
38. Item, I order as follows. After His Majesty granted me the towns, places and lands of my estate, which I hold and possess and which belong to me in New Spain, with the rents, levies, dues, tributes and contributions belonging to His Majesty, in the same way that the lords of those lands used to collect them before the land was conquered, I made every effort I could to find out what rents, tributes, levies, dues and contributions the native lords of that land used to collect in former times, and I took every care to obtain the old registers by which those tributes and rents used to be collected and paid; and I have collected the said rents and tributes in accordance with them up to the present day. I order that if it should at any time be found that I was misinformed in any way, matter or part of this, and have collected anything that did not belong to me, of which until today I have had no knowledge [the sentence breaks off here in the printed text; the sense appears to be that it be restored], and as for ever having collected anything undue, I lay this charge on the conscience of the said Don Martín, my son, and of those who are successors to my estate.
39. Item, since there have been many doubts and opinions about whether the native slaves of the said New Spain, both those taken in war and those obtained by barter, could be held in good conscience, and since this has not yet been determined, I order Don Martín, my son and successor, and those who succeed him in my estate, to make every inquiry needed to settle this for the discharge of my conscience and theirs.
40. Item, I order that, since in some places of my estate lands have been taken for orchards, vineyards, cotton fields and other uses, it be investigated and found out whether those lands properly belonged to any of the natives of those towns; and if so, I order that the lands be restored to them, together with the profit their owners could have drawn from them, offsetting and deducting all the tributes and rents they were obliged to pay for them. And I order that the same be done and understood concerning a certain piece of land, within the bounds of Coyoacán, that I gave years ago to Bernardino del Castillo, my servant, on which he built a sugar mill, if it should appear that the said piece of land belongs to some third party or parties.
41. Item, I order that, since besides the tributes I have collected from my said vassals I have received other services from them, both personal and in kind, and since there are also differing opinions on whether these may be received in good conscience, it be investigated likewise what I have received of these services beyond what was due to me, and that they be paid and given back everything they appear rightly entitled to.
42. Item, I order that all my account books be examined, especially a large book held by Francisco de Santa Cruz, which Juan de Ribera, my notary and secretary, began to keep, and in which office the said Francisco de Santa Cruz succeeded him, so that he now has the said books. Once they have been examined, I order that all the debts I owe to anyone according to them be paid, and that those owed to me be collected likewise. And I order that the said Francisco de Santa Cruz be made to render account for the time he had charge of my estates, that the account with him be closed, and that whichever party is found owing pay the other.
43. Item, I say that when Bernardino del Castillo married, I lent him a thousand castellanos of mine gold, in gold and silver, and a further six hundred in a shop next to the clock tower, as is shown by a note signed with his name, which is in the hands of the Licentiate Juan Altamirano. I order that, once what is owed to him for the time he has served me has been paid, in keeping with a note signed with my name that I left him when I set out from Coyoacán, the rest be paid by him to, and be had by, my said successor.
44. Item, I leave to Doña Elvira de Hermosa, daughter of Luis de Hermosa, resident of Ávila, who is a maid-in-waiting to the Marchioness, my wife, twenty thousand maravedís a year for as long as she wishes to live in the service of any of my said daughters or of the wife of the said Martín; and if she wishes to become a nun, or to live in this city without marrying, she is to be given two hundred thousand maravedís, to be paid from my estate or rents, the two hundred thousand maravedís being given to her in each year [so the printed text].
45. Item, I order that for as long as the lady Cecilia Vázquez Altamirano, my cousin, wishes to remain in the company of the Marchioness, my wife, as she is at present, or of any of my said daughters, or of the wife of the said Don Martín, my son and successor, she be treated with the respect that they have always known I wish her to be shown; and that she be given each year from my goods and estate, wherever she chooses to stay and live, one thousand maravedís, well and truly paid.
46. Item, I leave to two daughters of the accountant Juan Altamirano, my cousin, two hundred thousand maravedís each to help with their dowries and marriages, to be paid from my estate.
47. Item, I order that for as long as the said Juan Altamirano wishes to hold the office of accountant of my house, with which I entrusted him, on the terms I set for him in a note of mine, it not be taken from him, and that he be given it just as he holds it now, as long as he wishes to keep it.
48. Item, I leave to Doña Beatriz and her sister Doña Luisa, daughters of the Licentiate Francisco Núñez, maids-in-waiting to the said Marchioness, my wife, three hundred thousand maravedís to help with their marriages: two hundred thousand maravedís to the said Doña Luisa and one hundred thousand maravedís to the said Beatriz.
49. Item, I order that if María de Torres, the duenna who now lives with the Marchioness, wishes to remain in her service or in that of any of my said daughters or of the wife of my said son and successor, she be given fifteen thousand maravedís a year; and that if she wishes to do otherwise with her life, she be given one hundred thousand maravedís whenever she wishes, for these are in discharge of her service until now, without deducting from them anything she has received during the time she has served, nor any of the fifteen thousand maravedís that I order to be given her for the time she serves.
50. Item, I say that in the past year of fifteen hundred and forty-two, when I was in the city of Barcelona, forty ducats went missing from certain money of mine that was in the charge of Gonzalo Díez, who is now my master of horse, and I ordered that they be charged to his account so that they would be deducted from his wages. Although this does him no wrong, in view of the fact that he said, and I said, that they had been stolen from him, I remit and forgive them, and I order that no deduction be made from his wages on their account, and that if any has been made it be paid back to him in full. Besides this, in reward for his service to me, I grant him one hundred gold ducats, which I order to be given and paid to him from my goods.
51. Item, I order as follows. In the past year of fifteen hundred and forty-four, Pedro Hernández, my steward of the dais, gave me a bond for forty-four thousand five hundred and twenty maravedís, the value of certain pieces of silver that went missing from his charge while he was my steward of the silver, which he was bound to pay me. Now, in consideration of his service to me, I remit and forgive him the said bond, which I order to be handed back to him; and further I grant him twenty gold ducats, to be given and paid to him from my goods.
52. Item, I order that, besides being paid whatever is owed to him of his wages, Gerónimo de Andrada, my butler, be given and paid thirty gold ducats from my goods, which I grant him for his service to me.
53. Item, I say that lawsuits are being pursued on my behalf against the widow and heirs of the Licentiate Núñez, reporter of the Council, who was my solicitor at court, over certain accounts between him and me, on which he was left owing me large sums of money. Although I am well informed, and my conscience is clear, that these suits are not being pursued on my behalf with malice or cunning but only to obtain justice, nevertheless, acting in equity and to avoid expense and disputes, I say and order that, if the said widow and heirs of the Licentiate Núñez agree that two accountants appointed by them and two others by my executors should examine and settle these disputes and suits amicably, the matter be placed in their hands, both parties giving sufficient security and instruments; and that whatever those accountants order and decide be carried out and concluded without further legal dispute or lawsuit. If the other party does not wish to enter into this agreement, let the case or cases continue and be concluded by ordinary process, as they are being pursued now, for my intention is only that the truth be known and justice done. And I order that the money obtained or recovered from these suits be divided and distributed according to a memorandum held by Melchor de Mojica, my notary; and that the same be understood and done with the money obtained and collected from Francisco de Arteaga Martínez, in respect of the suits I am pursuing against him at present.
54. Item, I order that a girl who lives in my house and has been brought up there since she was a child, who is said to be the daughter of a certain Francisco Barco, born to him in Tehuantepec, be given thirty thousand maravedís from my goods to help her marry.
55. Item, I order that Juan de Quintanilla, who came from Valladolid to this city of Seville to serve and to tend me in my illness, be given, on the day of my end and death, if he is present, a suit of mourning clothes in keeping with what I have ordered concerning my servants; and besides this, that he be given fifty gold ducats from my goods, which I grant him for his service to me.
56. Item, I order that Pedro de Astorga, my page of the chamber, besides being paid whatever is owed to him of his wages, be given thirty gold ducats from my goods, which I grant him for his service to me in my illness; and in consideration of this, I charge and order the said Don Martín, my son and successor, to keep him in his house and service on the terms I order him to be given at present.
57. Item, I charge and order the said Don Martín, my son and successor, to keep in his house and service, as I keep him, Antonio Galvarro, my chamberlain, for I trust that he will give him good and loyal service, as he has given me during the time he has served me.
58. Item, I order that Diego González, resident of Medellín, who at present lives in this city of Seville, be given a coat and a cloak of fine black cloth, a pair of hose, a doublet and a cap, and twenty gold ducats as well, all of which I grant him because he is a good man and for the affection he has had and has for my house.
59. Item, I charge and order the said Don Martín, my son and successor, always to keep in his service and company Melchor de Mojica, my accountant, for from how well and faithfully he has served me in the short time he has been here in my house, I understand and trust that he will do the same from now on, and that the said Don Martín, my son, will receive good service and advice from him in the affairs and matters he has handled and dealt with together with me. And I charge and order the said Melchor de Mojica to do so, since I place this trust in him; and I wish and order that he remain in his office and on his terms, as and in the manner he is at present, for as long as he can, or as the Marquis wishes.
60. Item, I order that the hospital of the Amor de Dios be given and paid the alms which, according to the accounts and statement of Don Juan Galiano, appear to be owed of what was ordered to be given each month since I have been in this city of Seville; and further I order that another one hundred gold ducats be given to it from my estate.
61. Item, I order that the accounts of Master Vicente, for the work he has done for my house and chamber, be examined and checked at once, and that whatever they amount to, after deducting what he has received, be paid to him at once.
62. And since Don Martín Cortés, my son by the said Marchioness Doña Juana de Zúñiga, my wife, successor to my house and estate, is under twenty-five and over fifteen years of age, it is my will that he remain under the administration and guardianship of those whom I here name as guardians and curators of my children until they have reached the age of twenty-five years in full, and that within that term he not withdraw or excuse himself from that administration and guardianship, so that until he reaches the age I set his property and estate may be the better increased and improved, and, being thus preserved and administered, everything I order and dispose in this will may be fulfilled the better and the sooner. For the guardianship and administration of the goods of the said Don Martín, my son, and for the guardianship and care of the persons and goods of my legitimate daughters Doña María, Doña Catalina and Doña Juana, I name and appoint as guardians and curators the very illustrious lords Don Juan Alonso de Guzmán, Duke of Medina Sidonia, Don Pedro Álvarez Osorio, Marquis of Astorga, and Don Pedro de Arellano, Count of Aguilar. I beg them to be pleased to accept and take on themselves the said guardianship and care, and to receive and accept it, bearing in mind and taking into account that I ask and beg it of them, that my said children are of their blood and lineage, and that in favouring them in this they do what is owed by lords and kinsmen so close, and repay it in their own lineage and estate. In acknowledgement of some service, and of the fees that by law they would be entitled to take from my goods for the said guardianship, I order that they be given each year, from the goods in their lordships' charge, fifty marks of silver; and I beg them to accept this and be pleased with it, in view of the causes and reasons stated above. And I order that, until the said Don Martín, my son, successor to my estate, reaches the age of twenty, he be given twelve thousand ducats a year for the support of his person, household and servants, so that from the residue and remainder of my rents everything I leave ordered and directed in this will may be fulfilled and paid the more fully and quickly; and when he has reached twenty he may enjoy more. And since the towns and places, sugar mills and mines, and all the other properties that are entailed and belong to my estate and house, to which the said Don Martín, my son, is to succeed after my days, are divided and scattered, and lie in different provinces of New Spain far from one another, and since it is fitting and necessary that I, as the person who knows them best and understands them, should provide suitable persons for their administration, I ask and beg the said lords guardians and curators that their lordships be pleased to accept and abide by the appointment and provision of persons for this purpose that I shall leave made and signed with my name; for I hold it as certain that in this way those properties will be managed and administered as best suits them, and their lordships will be relieved of the labour and care of providing the persons who are to manage and hold them.
63. Furthermore, I leave and name as successor to my house and estate Don Martín Cortés, my son by the Marchioness Doña Juana de Zúñiga, my wife, and after him his descendants and the other persons called in the deed of my entail, which I established with the licence of the Emperor and King our lord, according to the form, conditions and restrictions and everything else contained in that deed; and, if necessary, I make and establish the said entail anew in the said Don Martín, my son, in the manner stated, by virtue of the said authority and licence I hold for it. And I leave the said Don Martín, my son, as my universal heir and successor in all my goods, movable and immovable, rights and claims, wherever I may have them and they may belong to me, outside the said entail. And I leave as heirs the said Doña María, Doña Catalina and Doña Juana, my legitimate daughters by the said Marchioness, my wife, in what I have ordered them to have for their dowries and legitimate shares; and I order them to be content with this, without claiming any other right or action against my goods by reason of their legitimate shares.
64. And to fulfil and pay this my will and the bequests it contains, I leave and name as my executors in these kingdoms of Spain the said very illustrious lords the Duke of Medina Sidonia, the Marquis of Astorga and the Count of Aguilar [the printed text adds «(marques)»], to all three together and to each of them on his own, jointly and severally, I give full power to enter upon and take, on their own authority, from my goods and estate, any or all of the amount needed to fulfil everything stated and declared in this will and the bequests it contains; and, if necessary, they may sell those goods at auction or otherwise, as they see fit, and pay and fulfil this my will. I ask and beg these lords to discharge my conscience and to have everything in this will fulfilled and paid in effect. And for what concerns New Spain and is to be provided for and done in those provinces, according to the form and manner I have declared and ordered in this will, I leave and name as my executors the Marchioness Doña Juana de Zúñiga, my wife, the lord Bishop of Mexico, Fray Juan de Zumárraga, Father Fray Domingo de Betanzos of the Order of Saint Dominic, and the Licentiate Juan de Altamirano, who are at present in the said New Spain. And I revoke any other will or wills I may have made and executed, and I wish and will that they be neither valid nor carried out, except this one that I now make in writing; and I likewise revoke any codicil or codicils I may have made and executed in writing or by word of mouth in times past. It was seen and read in my presence, all exactly as it is written, and I signed it with my name, and it is marked by my hand on every sheet, which are ten including this one on which it is signed; and [the signature] also appears on all the said sheets, which signatures I set down in the presence of the Licentiate Infante. Done in Seville on the eleventh day of the month of October, in the year of the birth of Our Lord and Saviour Jesus Christ one thousand five hundred and forty-seven.
Addition: the four thousand ducats in full → ES
Item, I say that, whereas in a clause of this my will I have stated and ordered that the four thousand ducats which the houses and shops I own in the city of Mexico yield and are worth be assigned in full, from the time the works of the said hospital, convent and college I order to be made are complete and finished, to the endowment and revenue of the said college, convent and hospital, as stated in the said clause to which I refer; and whereas it may happen that at some time the said shops and houses yield less than the said four thousand ducats, and it is my intention and will that the full amount be given and made up for the said endowments: I ordain and order that whatever falls short in any year be given and made up by the successor of my house from his own goods, so that the said four thousand ducats are paid in full without any reduction. And this is added to the ten sheets contained on the other side, done and signed on the same day, month and year. — The Marquis del Valle. — By order of his lordship, as witness, the Licentiate Infante. — By order of his lordship, Melchor Mojica.
